Welcome to SupermanAds, a programmatic advertising platform provided by Adsflourish. These Terms of Service (“Terms”) govern your access to and use of our platform, website, APIs, and associated services (collectively, the “Services”).

By using our Services, you agree to be bound by these Terms and our Privacy and Cookie Policies.

Definitions

• “SupermanAds”, “we”, “us”, “our”– refers to Adsflourish and its product/platform.
• “User”, “You”, “Client”, “Advertiser”, or “Publisher”– refers to any individual or organization accessing or using the Services.

Eligibility

To use our platform, you must:

• Be at least 18 years old.
• Have the authority to enter into a binding contract.
• Not be prohibited by law from accessing our services in your country.
• Not be listed on any sanctions or restricted persons list.

Account Registration

You may need to create an account to access full functionality. You agree to:

• Provide accurate and updated information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized access or suspicious activity.
• Take full responsibility for activity under your account.

Services Overview

SupermanAds offers:

• Programmatic media buying services & tools
• Campaign management features
• Real-time bidding integrations
• Advanced targeting (demographics, behavior, geolocation, device, etc.)
• Retargeting and attribution
• Analytics and reporting dashboards

We may change, suspend, or discontinue parts of the Services at any time without prior notice.

Use Restrictions

You agree NOT to:

• Upload, serve, or promote content that is misleading, illegal, hateful, or harmful.
• Use bots, malware, or engage in any fraudulent behavior (e.g., click fraud, impression inflation).
• Interfere with the platform’s operation or security.
• Reverse engineer, decompile, or copy our proprietary technology.
• Use our Services for unauthorized reselling or sub-licensing.

Fees & Payments

• Fees may apply for media buying, ad serving, or platform access.
• All charges are due as per your contract or billing cycle.
• Late or non-payment may result in account suspension.
• Taxes, including GST or VAT, will be your responsibility unless stated otherwise.

Data Usage

We collect and process data in accordance with our Privacy Policy. This includes:

• Device information
• Ad interaction metrics
• IP address, browser type, OS
• Geolocation data

You confirm that you have necessary consents to share user data with us (if you are a publisher or advertiser collecting end-user data).

Intellectual Property

• All content, code, and technology on the platform are owned by Adsflourish.
• You may not use any trademarks, logos, or content without written permission.
• You retain ownership of any content (ads, creatives) you upload, but grant us a license to use it for service delivery.

Termination

We may suspend or permanently terminate your account for:

• Breach of these terms
• Inactivity for an extended period
• Non-payment
• Legal obligation or abuse of services/platform

You may also terminate your account at any time by contacting us.

Confidentiality

Any business, technical, or strategic information shared between parties shall be kept confidential unless:

• Required by law
• Already public knowledge
• Disclosed with mutual consent

Warranties Disclaimer

We provide our services/platform “as is” and “as available,” and disclaim all warranties, including:

• No guarantee of ad campaign performance
• No warranty that the platform will be error-free or uninterrupted
• No responsibility for actions of third-party partners

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, special, or consequential damages.
• Our total liability in any claim is limited to the amount you paid us in the previous 3 months.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your campaigns or creatives
• Your use or misuse of the Services

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Gurugram.

Dispute Resolution

We encourage informal resolution of disputes first. If needed, parties agree to binding arbitration in Gurugram under the rules of District Court of Gurugram.

Changes to These Terms

We may revise these Terms occasionally. Any major changes will be notified on the platform or via email.
